1 Registration and conclusion of contract
Your binding registration for the offer you have selected from Switzerland Innovation Park Ost AG (“ SIP Ost ”) takes place online on the website of SIP Ost or its associated partners or service providers. SIP Ost is entitled, but not obliged, to accept registrations that SIP Ost receives in a different form (e.g. personal telephone inquiry, etc.). You are bound to your registration for a period of 10 days. When SIP Ost sends the registration confirmation by email, a legally binding contract is concluded between you and SIP Ost.
The registration confirmation sent automatically immediately after registration is only valid as registration confirmation if this is expressly noted in the text.
SIP Ost can withdraw from the contract with you for various reasons, for example if the contractual provisions are violated, insolvency occurs or uncertainties arise during a possible credit check.
By registering, you acknowledge that these General Terms and Conditions (GTC) become part of this contract. Differing or additional provisions to these General Terms and Conditions only apply if they have been agreed in writing. This also applies to the waiver of this formal requirement or the change to this provision.
2 Offers and subject matter of the contract
SIP Ost offers various offers, such as events, sponsorship, membership, use of rooms (“ room rentals ”), etc. The current offers are listed on its website. All offers are non-binding. SIP Ost expressly reserves the right to change, supplement or delete offers or to temporarily or permanently stop publication without prior notice.
If a contract is concluded, SIP Ost undertakes to carry out the offer as described on its website or associated partners or service providers or in the information flyers published by SIP Ost. For organizational reasons, SIP Ost reserves the right to postpone offers, change the location, etc. If a speaker is unavailable, SIP Ost can appoint another speaker, postpone or cancel the offer. If there is a contradiction between the website and the information flyers, the description on the website takes precedence.
3 Participation fee and payment conditions
The amount of the participation fee can be seen on the website of SIP OST or its associated partners or service providers. This fee is binding. Registration requires you to pay the participation fee. If you would like an invoice instead of registering online, we will charge a fee of CHF 20 for the administrative effort. Failure to pay the participation fee does not constitute cancellation.
Your participation fee is due at the time of registration. For electronic payment processing, we work with an appropriate payment provider. In exceptional cases, payment by invoice or in cash is possible. An additional processing fee may apply. For payments by invoice, the payment deadline is 10 days from the invoice date. The invoice will be sent by SIP Ost via email. After the payment period has expired, the entire outstanding participation fee is automatically in default. All amounts that are not paid within the payment deadline are subject to interest at the rate of 5% annually. In addition, SIP Ost is entitled to charge a fee of at least CHF 20.00 for each reminder.
4 Cancellation conditions
If you are unable to participate for any reason after registering for an event, you must report this immediately to SIP Ost in writing (an email to info@innovationspark-ost.ch is sufficient). You are then entitled to send a replacement person. The contact details of the replacement person must also be provided to SIP Ost in writing (e-mail is sufficient). If no replacement person is sent, 50% of the participation fee will be refunded if you cancel up to 20 days before the start of the offer; If you cancel later or if you do not appear without canceling, the entire participation fee will be forfeited to SIP Ost. If the offer is canceled by SIP Ost, you will receive a full refund of the participation fee.
For room rentals, if you cancel up to 20 days before the start of the offer, 50% of the usage fee will be refunded; If you unsubscribe later, the entire usage fee will be forfeited to SIP Ost. If the offer has to be canceled by SIP Ost, you will receive a full refund of the usage fee.
Registration can take place within the deadlines stated in the offer.
5 Liability and warranty
SIP Ost is liable for any damage, subject to the following paragraph, in the event of intent or gross negligence. Any further liability, regardless of the legal basis, in particular in the case of slight negligence or for indirect and consequential damages, such as lost profits or third-party claims, is expressly excluded to the extent permitted by law.
SIP Ost assumes no responsibility and does not guarantee that the functions on the SIP Ost website will not be interrupted or are error-free, that errors will be corrected or that the website and the respective server are free of viruses or harmful components. SIP Ost assumes no liability for damages related to the operation of the website.
SIP Ost works with the greatest possible care on the website and social media channels. We incorporate contributions from our partners. If individual contributions violate the rights of third parties or contain illegal content for other reasons, the respective author is responsible for the legal violation. The operators of the corresponding websites are solely responsible for linked information. SIP Ost has no control over the content of contributions from partners or linked information. Accordingly, SIP Ost assumes no liability for the content of such contributions or linked information, including their accuracy, completeness, reliability or suitability for specific purposes.
6 Image rights and data protection
By registering, you, as a participant in an offer from SIP Ost, agree that SIP Ost or its partners or service providers may publish photos and films of the offer, in which you could possibly be seen, on their own website and for their own advertising purposes used. Your consent can be withdrawn at any time by informing us at the address below.
SIP Ost processes your personal data in accordance with the provisions of Swiss data protection legislation. Otherwise, the data protection declaration available at www.innovationspark-ost.ch/datenschutz/ applies .
7 Final Provisions
SIP Ost is entitled to unilaterally change these General Terms and Conditions at any time. The current and binding version can be found directly on the SIP Ost website. Swiss law applies exclusively, excluding the conflict of laws and the United Nations Convention on the International Sale of Goods (CISG). The exclusive place of jurisdiction is the city of St.Gallen.
